SENATE CONCURRENT RESOLUTION NO. 14

Requesting the Joint Committee on Government and Finance to conduct a study on the changes made to the Title XIX Medicaid Waiver Program for the disabled and elderly regarding the distribution and availability of slots.

Whereas, Recent departmental changes regarding the distribution of available slots in the Title XIX Medicaid Waiver Program have the potential to severely affect the health and welfare of West Virginia's disabled and elderly citizens; and
Whereas, It is the duty of the Legislature, as elected representatives of the people, to review departmental policies that have a direct effect on the health, safety and welfare of the citizens of West Virginia; and
Whereas, The recent departmental changes to the Title 19 Medicaid Waiver Program regarding the distribution and availability of slots throughout the state deserve examination by the Legislature prior to its implementation on March 1, 1999; and
Whereas, Due to the urgency of the departmental changes made to the Title XIX Medicaid Waiver Program regarding the distribution and availability of slots, the issue cannot be fully examined within the sixty-day regular session of the Legislature; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby requested to review, examine and study, during the interim of the Legislature, the departmental changes by the Department of Health and Human Resources, Bureau for Medical Services, relating to the Title XIX Medicaid Waiver Program and the distribution and availability of slots; and, be it
Further Resolved, That the Legislature hereby requests a moratorium on the departmental changes that will be implemented by the Department of Health and Human Resources, Bureau for Medical Services, to the Title XIX Medicaid Waiver Program, as they relate to the distribution and availability of slots within the waiver program, which will be implemented on March 1, 1999, pending an interim study by the Joint Committee on Government and Finance; and, be it
Further Resolved, That the Joint Committee on Government and Finance is hereby requested to review, examine and study, during the interim of the Legislature, the departmental changes by the Department of Health and Human Resources, Bureau offor Medical Services relating to the Title XIX Medicaid Waver Program, and the distribution and availability of slots; and, be it
Further Resolved, That the Joint Committee on Government and Finance report to the regular session of the Legislature, 2000, on its findings, conclusions and recommendations, together with drafts of any legislation necessary to effectuate its recommendations; and, be it
Further Resolved,
That the expenses necessary to conduct this study, to prepare a report and to draft necessary legislation be paid from legislative appropriations to the Joint Committee on Government and Finance.<<>>Further Resolved, That the Joint Committee on Government and Finance is hereby requested to make a report of its findings, conclusions and recommendations, together with drafts of any legislation necessary to effectuate its recommendations to the regular session of the Legislature, 2000; and, be it
Further Resolved, That the expenses necessary to conduct this study, to prepare a report and to draft necessary legislation be paid from the legislative appropriations to the Joint Committee on Government and Finance.
